In these Terms “you” means any candidate, employer, jobseeker, individual or corporate entity using our website. Users of our website must be 18 years or older and in continuing to use our website you warrant to us that you are of such age. 

INFORMATION ABOUT US

www.crew-it-all.com is a site operated by crew-it-all (we/our/us). Our main trading address is Southend-on-Sea, Essex, SS2 4AN.

We specialise in introducing candidates to potential employers for positions in the luxury yacht, private aircraft and luxury cruise liner industries, as well as shore-based hospitality positions. We offer the following services:
 
• Candidates may post their CVs on our candidate database. Employers are then able to search a list of anonymised CVs for potential candidates. If they find a candidate they consider might be suitable, they may purchase that candidate’s CV for a fee, which will be stated on the website and will be payable to us. The employer will then contact the candidate directly; we will not be involved in making an introduction.


• Employers may post job opportunities on our jobs database. Candidates may then search the jobs database and if they find a job in which they are interested they may contact the employer directly.  We will not be involved in making any introduction.


• We also provide a personalised recruitment introduction service, whereby employers may engage us as agents to provide services for the introduction of personnel.  A separate recruitment agency agreement shall govern the terms and conditions of the provision of such services

ACCESSING OUR WEBSITE 

Access to our website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our website without notice (see below). We will not be liable if for any reason our website is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our website, or the entire website, to users who have registered with us.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms. Should you become aware that unauthorised access or use of your account has been made you must immediately change your password and contact us.  We shall not be liable for any loss or damage suffered as a result of unauthorised access to your account, unless such unauthorised access is a direct consequence of our negligence.

RELIANCE ON INFORMATION POSTED


The CVs and job opportunities posted on our website are posted by candidates and employers. We do not:

• check the identity of candidates or employers;
• follow up or check any references of applicants;
• verify any information included in a CV or job listing;
• check the validity of any qualifications;
• make any Criminal Records Bureau checks;
• make any POVA or POCA checks;
• make any Vetting and Barring Scheme checks;
• interview or communicate with the candidates;
• check or verify working permits, visas or passports;
• employ any candidates or applicants in any manner.

You acknowledge that we do not warrant the accuracy or completeness of any information contained on the website, nor do we provide any commitment to ensuring that the material on the website is up to date. Commentary and other materials posted on our website are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our website, or by anyone who may be informed of any of its contents.

 

The search filters provided on the website are intended to assist you in finding a candidate or job listing that meets your criteria and the narrowing of results by using such filters does not in any way amount to a recommendation or indication of suitability of any candidate for a post or any job for an applicant. Employers should be aware of any local and international laws that may affect the way in which they may use the search filters provided.

We aim to update our website regularly, and may change the content at any time. If the need arises, we may suspend access to our website, or close it indefinitely. Any of the material on our website may be out of date at any given time, and we are under no obligation to update such material.

JOBSEEKERS

By registering as a jobseeker, you warrant that all information you provide to us and to any registered recruiter via our website including without limitation all information in your CV and profile and documentation is true and accurate and you undertake to keep all such information up to date.
Registered jobseekers may have access to areas of the website and services that are non accessible to non-registered users.  These areas and services will be determined by us in our sole discretion any may include:

• The facility to upload a CV and/or profile into our database, which will enable registered recruiters to see the CV and/or profile;

 

• The ability to limit the disclosure of confidential information to registered recruiters;

• The provision of e-mail alerts, newsletters, notices of competitions and/or other e-mail notifications from us;

 

• The option to upgrade to “Featured Crew” status for payment of a fee to us, which will be stated on the website and may be varied from time to time, whereby your profile will be presented on the registered recruiters’ pages in a manner considered to be fair and reasonable by us in our sole discretion.

We reserve the right to modify or discontinue the provision of any area of the website or service and we shall not be liable for any loss or damage arising as a result of such modification or discontinuance. 

crew-it-all is an introduction only service and under no circumstances do we accept any responsibility for or will we be liable for salaries, contributions, expenses, travel costs or other expenses or remuneration due prior, during or after an introduction is made.

You may hide your profile at any time using the Profile Visible link in the With Us tab.

You acknowledge that we may at any time without notice or explanation delete your account and/or discontinue the website and/or website services.


RECRUITERS

The fee chargeable to registered recruiters for access to CVs on our database will be shown on the pricing tab, which will also give details of the period of your subscription, the number of CVs you have access to, and the level of candidate experience you have subscribed for. All charges stated on the website are exclusive of VAT unless otherwise stated. Fees must be paid in advance, in cleared funds, in accordance with the instructions on the website, before access will be provided to any chargeable material.

We reserve the right to vary our charges, the number of available CVs and subscription periods from time to time and any such changes will be shown on the pricing tab on the website.  Any such variations will not affect services that you have already paid for. 


By registering as a recruiter you warrant that all information you provide to us and to any registered jobseeker via the website (including without limitation all job advertisements) is true and accurate and you undertake to keep all such information up to date. You hereby warrant that all job advertisements submitted to the website for publication are true, accurate and complete advertisements for bona fide jobs.


You agree that any information passed to you from our database will be used in accordance with all applicable privacy and data protection laws and solely for the purpose of seeking candidates to fill bona fide jobs; you will treat such information as confidential and will not copy any such information or record or retain it or disclose it to any third party.
Registered recruiters may have access to areas of the website and services that are non accessible to non-registered users.  These areas and services will be determined by us in our sole discretion any may include:

• The ability to post advertisements on our website;
• The ability to access jobseeker’s CVs held on our database on payment of a fee;
• The ability to send anonymous availability requests to candidates registered on our database.

We reserve the right to modify or discontinue the provision of any area of the website or service and we shall not be liable for any loss or damage arising as a result of such modification or discontinuance.

You may suspend or cancel your account at any time by sending an e-mail to admin@crew-it-all.com

In addition to our right to cancel or suspend your account as otherwise specified in these Terms, we may cancel your account without cause on giving you no less than 30 days’ written notice of termination.  In that event, you will be entitled to a pro-rated refund of any fees paid to us in respect of the provision of services for any period after the effective date of cancellation of your account.

Please note that we are legally obliged to maintain records of any recruitment activities for a period of five years.

UPLOADING MATERIAL TO OUR WEBSITE

Whenever you make use of a feature that allows you to upload material to our website, or to make contact with other users of our website, you must comply with the content standards set out in our acceptable use policy

You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty. 

Any material you upload to our website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our website constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our website. We reserve the right to remove any content or posting you put on our website if, in our opinion, such material does not comply with the content standards set out in our acceptable use policy

or if we in our sole discretion believe that such material is not appropriate or suitable to be on our website or that it is in our best interests to remove such material.

REFUND POLICY

If you are not happy with our services then please e-mail us within 30 days of commencing your subscription and we will refund any fees you have paid to us.  To qualify for a full refund, please state the following in your e-mail: full name and address; company name and address; service purchased; vessel’s name; reason for your dissatisfaction.

 

VIRUSES, HACKING AND OTHER OFFENCES


You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our website via a denial-of-service attack or a distributed denial-of service attack.


By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our website will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website linked to it.

Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

We have the right to revise and amend these Terms from time to time. You will be subject to the Terms in force at the time that you log on to the website. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.
